Of course, the digital signature without certificate can be used, but some evidence will be needed to meet the requirements of the advanced electronic signature, such as the SMS OTP that will be sent to the signatory’s mobile phone in a way that allows its identification or by biometric signature through external devices suitable for the capture of biometric data.
Therefore, the digital signature can be used without a certificate. With any of these signature modalities, sufficient data is captured, generated and stored to guarantee the basic principles of an advanced electronic signature:
- Signatory identification.
- Unique linkage to the signer and the data.
- Ability to detect any subsequent changes.
- Guarantee that only the signatory can generate the signature.
Viafirma’s suite of products allows all these signature modalities, and even gives the option to add more evidences, such as the geographic location at the moment of the signature, photographs, attachments, time stamp… In this way, it provides evidential burden to give more legitimacy to the signature in case of repudiation.
