Electronic signature types with Viafirma
The electronic signature must guarantee the authenticity, confidentiality and integrity of the signed message or document. For this purpose, different authentication methods or factors or identity data are used. The main types are:
- Digital signature: It is a numerical value that is added to a message or document and guarantees its integrity and authenticity by means of asymmetric cryptography and a digital certificate.
- Electronic signature: Any method that makes it possible to identify a person in relation to a message or document.
- Certified electronic signature: Any method of electronic signature made with identity factors or data, which includes a digital certificate to guarantee its security and integrity.
New developments in the Electronic Signature Law of 2015
The validity and regulation of electronic signatures in El Salvador is reflected in the Electronic Signature Law of 2015. In it, both the simple electronic signature and the certified electronic signature – in Spain, known as advanced electronic signature – are equated with the autographic signature. Both have full legal validity.
It is important to point out that this law includes the concept of digital signature, but refers to cryptographic methods that, rather than for signing, are related to credit card PINs.
Since the passage of the 2015 E-Sign Act, this law has undergone updates and improvements, the two mentioned below being the most significant:
- Regulation of the Electronic Signature Law (2018). Establishes the procedures for the issuance and use of digital certificates, and defines the responsibilities of certification service providers.
- Legislative Decree No. 100 (2021). It established the mandatory use of electronic signatures for certain procedures and documents, both in the public and private sectors: incorporation of companies, issuance of electronic invoices, filing of tax returns…In addition, following this decree, entities must implement electronic signature systems to carry out procedures and issue documents.
